What information do we collect about you?

Fontaine Decorative Ltd collects information about you when you voluntarily subscribe to our mailing list. The information requested from you consists of an email address and in some cases, your name and a contact telephone number which have been collected in order to provide you with periodic updates about us, our products and news of events including complimentary tickets to any shows which we may be exhibiting at.

We may also collect information from you when you engage with us in a sale for any of our products. This includes your name, your invoicing and any delivery addresses and a contact phone number

Information relating to usage of our website is collected using cookies. This forms a browsing history where certain text files are placed on your computer to collect standard internet log information and visitor behaviour information. We’ll use your information collected from the website to personalise your repeat visits to the site and make your browsing experience faster and more seamless.

You can request what information we hold about you at any time.

Why do we need to collect and use your personal data?

The primary basis of collecting information about you is solely for the intention of communication to you about our products, services, news and other information about us including events or promotions. The information that we collect about you is essential for us to be able to communicate this information to you. We are also legally required to collect essential information from you when you engage in a sale with us for the processing of any credit card payments where the cardholder is not present (CNP). Any information obtained by Fontaine Decorative Ltd about any credit or debit card payments are not retained or stored on any electronic database or accounting program and we are fully PCI DSS compliant.

We will always obtain your explicit consent in order to collect and process this information.

We collect information about you in order to provide you with promotions, events, news and any services for which you engage us.

We do not and we will we never share your information for marketing purposes with companies outside of Fontaine Decorative Ltd and your information will remain confidential and secure at all times.

In principle, your subscription data will be held by us unless we are requested to remove it by you. You have the right and can request to remove this data at any time by contacting us or simply by unsubscribing to any global mailed communication that you receive from us.

FONTAINE DECORATIVE LTD TERMS OF BUSINESS

Fontaine is a trading name of Fontaine Decorative Limited, incorporated in the UK number 8932803. Our trading address is Uplands, Burtons Lane, Wellington Heath, Ledbury, Herefordshire, HR8 1NF.

Terms of Trade

Title of goods supplied on our invoices are payable within the terms stated and remain the property of Fontaine Decorative Ltd until payment of cleared funds is received in full. Goods are non-returnable and non-refundable unless expressly by prior agreement. By accepting our invoice, you agree to accept our terms and conditions of trade which are summarised below.

Descriptions

We will always endeavour to provide an accurate and detailed description of the items offered for sale both in-store and online based on our own knowledge or expertise of the item, the knowledge or expertise imparted to us when we purchased the item and any other information including personal research and comparisons with similar items recently sold or offered for sale on the open market by our contemporaries. We make every effort to describe and photograph our items for sale as accurately and as carefully as possible on our website. However, please be aware that some photography may produce some glare and variation in tone and colour. Our description of the item will include date, country of origin, material(s), maker’s name (if applicable), and details of any provenance, damage, embellishments or restoration. We will always declare items which have been modified or changed from their original use.  All measurements provided are of the maximum projections of the item.

Disclaimer

Notwithstanding any of the above, we are not liable for any misrepresentations outside of our control including misinformation and technical issues with regard to the photography of items.

UK and EU Internet sales

If a sale is agreed on an item or several items, we will issue a sales invoice which will give details of how payment can be made to Fontaine Decorative Ltd. If you require a pro-forma invoice, please state this at the time of ordering together with your Purchase Order reference number and details of where we should send the pro-forma for payment. Pro-forma invoices are issued only when there is a fair certainty that you will purchase the item(s) ordered and the item(s) will be then be reserved for no more than seven days. Invoices (including pro-forma invoices) are payable immediately and are valid for a period of no more than seven days and the invoiced goods will only be released for despatch or collection once payment has been received in full. Should payment not be received within seven days from the date of emailing, the invoice will be cancelled and the item(s) returned to stock.

Returns - Online sales

If you receive an item purchased on our website which has not been viewed at first hand and you feel that it is not as described, is not suitable, or you are simply not happy with it you may return the item, provided that we are notified within 24 hours of delivery/receipt and that you have our agreement. In all cases, return carriage is not included and the cost of this must be paid for by you. We will always try to facilitate you in returning any such items to us as quickly and as cost effectively as possible. Where agreed, items must be returned within seven days of notification to us.

For internet sales made outside of the UK, please contact us for further advice on dealing with returns.

Special Orders

We regret that any items whether bought online or in-store and which have been commissioned or modified by us at the customer’s request or which are bespoke, are non-returnable and non-refundable unless they are faulty or damaged.

Damaged Goods

If you receive goods which have been damaged in transit or are faulty, please notify us immediately and within 24 hours of receipt together with supporting photographic evidence and we will advise further on how to return the damaged item(s) to us. We shall not be held responsible for damage arising from the transportation of goods which have been collected by the client or on behalf of the client.

For internet sales made outside of the UK, please contact us for further advice on dealing with returns of damaged goods.

Exchanges, Credit Notes and Refunds

A credit note or refund will be issued within ten days of receipt by us of any returned goods provided that they are in the same original and re-saleable condition, less our original carriage costs.

If a credit note or refund is required for a returned item that was originally purchased unseen from our website and which had subsequently been stored at the client’s request, you must notify us immediately and within 24 hours of receipt and that item should then be returned at your expense within seven days. We will always try to facilitate you in returning any such items to us as quickly and as cost effectively as possible. A credit note or refund will then be issued to you within thirty days of receipt by us of the returned item provided that it is in the same original and re-saleable condition. Before a refund is issued we will calculate and deduct our costs for storage of the item from the invoiced date to the delivery or collection date at the rate of £ 10.00GBP plus VAT per week plus a 20% handling and restocking fee of the original ticket price of the item plus VAT, plus our original carriage costs (if any).

For items returned to us that were purchased online and are delivered damaged or are faulty, we will offer to repair or restore the item. If repair or restoration is not possible, a replacement will be offered if it is available, or a credit note or a full refund including any reasonable costs of returning the goods to us. If you wish to retain the damaged goods, we may be able to offer a further discount subject to inspection and a new valuation of the item(s).

Storage

Our storage space is very limited and as such, any items purchased in-store or from our website which are subsequently not taken, delivered or collected can only be stored by prior arrangement for a period of up to three months after which we reserve the right to charge a fee of £15.00 GBP plus VAT per week, per item for storage. All storage charges are invoiced monthly.

If storage of purchased goods exceed a reasonable amount of time or storage charges exceed the value of the original goods purchased, we will notify you with TWO WEEKS NOTICE and ask you to collect the goods and settle any outstanding balance after which time the item will be placed back into stock and re-sold. We reserve the right to sell the item at a reduced price to recover any such charges incurred. If there is a balance due after the sale of any such items and after we have deducted our charges, this will be remitted to you at you by cheque within 10 working days.

Delivery

We always recommend that purchases are collected by you whenever possible. We offer a Free of Charge (FOC)* UK delivery service on many of our items and these will be dispatched where possible by normal carrier or by overnight postal services. 

Larger and more fragile items including glass and mirrors, some lighting, porcelain, plasterwork, delicate or high value items, and any other item deemed by us to be unsuitable for overnight postal and carrier services, will be managed and delivered by an insured and dedicated driver service.

Delivery Charges

Where delivery / shipping destined to a UK delivery address is shown as being included and it can be shipped by an overnight postal or courier service, this is included Free Of Charge*. 
For the shipping of larger and / or more fragile items to UK addresses deemed by us to require a dedicated driver delivery service (except for Northern Ireland, Channel Islands, Scottish Isles, some remote Scottish Highlands, Isle of Man and Isle of Wight)  the price of this is shown, subject to VAT.  Our dedicated driver delivery service covers mainland UK only and the provision of this service will be confirmed when we are provided with the delivery postcode.

*Delivery is offered 'Free of Charge' (FOC) only in lieu of any trade discounts, promotion, or price reduction.  Delivery is not included where a price reduction has been agreed or is offered by us.

Delivery Exclusions

For all European and other UK or Worldwide excluded destinations and / or for the shipping of any exceptional or very large items as highlighted, or if you require a two person delivery service, we can normally obtain a competitive shipping quote to offer a fast and professional delivery service with national reputed couriers who will deliver your purchased item(s) direct to your door.  

Unless otherwise specified, any P&P / shipping charges provided or quoted by us are subject to VAT. 

Restrictive export conditions and tarifs due to BREXIT have made it difficult to secure deliveries of larger items to the EU and deliveries of these larger items requiring a dedicated driver are currently suspended.

Delivery Terms

Any delivery quotes provided are invoiced and payable prior.  We will endeavour to deliver your item(s) on an agreed date and within a given delivery time slot, subject to external delays howsoever caused.  Delivery costs are quoted net and are subject to VAT.

  • All van deliveries arranged by us whether provided FOC or not will be made by one person. Please be prepared to help our driver with any heavy or cumbersome items.  If a two person delivery team is required, this must be specified when the order is placed.
  • We will normally offer to place items in situ. Please ensure that there is clear and unrestricted access.
  • Our driver will not be prepared to move other personal items of furniture.
  • Please advise if there are any stairs in the property where the goods are to be delivered or if the property is further than 30 metres from the parking area.
  • Please ensure that you notify us of any parking restrictions or access difficulties at the delivery address.
  • Additional inner-city congestion and emission charges may be applied at our discretion.

Please ensure that the item(s) being delivered are going to fit through any doorways or tight spaces.  There will be a minimum charge of delivery plus a 10% handling, restocking and return fee for any item(s) returned to us where delivery has not been possible due to access problems.

Delivery Times

If your item is required urgently, please let us know and we will do our best to prioritise delivery for you.  You can request and pay for a premium delivery service if required, otherwise please be advised that any free or promotional shipping services offered by us depend on availability and we will usually try to consolidate items in order to econimise and minimise unnecessary journeys.  Orders received for items which can be sent by an overnight postal or carrier service are normally dispatched within five days of payment being received.  If your item is being dispatched and delivered by a dedicated driver, please be prepared for delivery to take up to 28 days whilst we organise the most economical service for you unless you have requested and paid to upgrade your delivery.

Approval Items

Our ‘On Approval’ service is offered completely at our own discretion.  We allow up to a maximum of three items to be sent out for approval at any one time and this service is only available within a 100 mile radius of our location in Herefordshire unless coillection is arranged separately.

Where an approval service is agreed by us, we will request full pre-payment of the agreed price of an item (or items) by BACS, plus any associated VAT inclusive delivery charge incurred if applicable.  The goods will be released after payment has been received in full and shipping will then be arranged on an agreed date.  If on approval, the item is subsequently not required or is unsuitable, payment will continue to be held on account in lieu of any return shipping charges and to indemnify us against any damage.  We kindly ask that your approval items are handled carefuly.  If in the event that any damage is sustained to any item during the approval period as a result of mishandling, this will be discussed with the client before a refund is issued. 

We can offer a waiting approval service whereby our driver will deliver and place your item or items in situ and wait for you to make a quick 'on spot' decision.  Any unsuitable or unwanted item(s) can then be immediately removed and returned to us. The charge for waiting approvals is the delivery charge multipied by 1.5 but if the item is immediately approved and therefore not returned, only the original shipping charge shall apply unless delivery of the item is offered FOC. 

If it is necessary to keep the item(s) on approval for a longer period, we ask that if they are subsequently not required, that we are notified as soon as possible and within 48 hours of delivery in order that we can arrange for the item(s) to be collected.  All returned items must be in their original unmarked and re-saleable condition.  If we arrange for these items to be collected, the collection charge for this would be equivalent to the original shipping charge and this would be deducted from the refund amount. We cannot guarantee collection within 48 hours but we will always try our best.

If you are satisfied with your approval items and you wish to keep them, there will be no further charge.

Unless by prior arrangement, all of our deliveries are made by one person and large items will require assistance.  In all cases, please refer to our terms of delivery above for further advice and information on the delivery of items.

Reservation of Stock

Items may only be reserved for a period of between 48 hours and up to SEVEN days at our discretion.

Payment

We prefer to accept payment by BACS or Wire Transfer. Our bank account details are shown on our invoices. We also accept £GBP cheques drawn on a UK bank account and all major Debit and Credit cards including Amex. We regret that PayPal is not accepted.

Warranty

We offer a three month guarantee against any defective or faulty item restored by us including electrical items and upholstery. Our guarantee does not cover wear and tear or damage arising from disproportionate use or misuse. Your statutory rights are not affected.

VAT

VAT has not been, nor will be claimed in respect of any of the goods supplied and invoiced by us except where it is shown to have been charged on other services such as commission sales, shipping and storage costs or any other goods or service(s) provided that are not covered under the VAT Global Accounting Scheme.
